1. Acceptance of Terms

By accessing or using the Almiola platform ("Platform"), including our website and mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Almiola.

2. Eligibility

You must be at least 18 years of age to use Almiola. By using the Platform, you represent and warrant that you meet this requirement and that all information you provide is accurate, complete, and current.

3. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Buying on Almiola

4.1 Orders

When you place an order, you make an offer to purchase. The contract is formed upon our confirmation of your order. We reserve the right to cancel orders due to pricing errors, stock unavailability, or suspected fraud.

4.2 Pricing

All prices are displayed in Lesotho Loti (LSL) unless stated otherwise. Prices are subject to change without notice. Promotional prices apply only for the specified period.

4.3 Payment

We accept M-Pesa, EcoCash, card payments, bank transfer, and cash on delivery where available. Payment must be completed before goods are dispatched (unless cash on delivery is selected).

4.4 Delivery

Delivery timelines are estimates and not guaranteed. Risk of loss passes to you upon delivery. Almiola is not liable for delays caused by third-party couriers or circumstances beyond our control.

5. Returns & Refunds

Returns are subject to our Returns & Replacements Policy. Items must be returned in original condition within the applicable return window. Refunds are processed to the original payment method or as store credit. Certain items (e.g., digital downloads, perishables) are non-returnable.

6. Seller Marketplace

Almiola hosts independent third-party sellers. We are not responsible for the quality, safety, legality, or accuracy of items listed by sellers. Transactions with sellers are between you and the seller, though Almiola may facilitate dispute resolution. Sellers must comply with our Seller Terms.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Post false, misleading, or fraudulent content.
• Attempt to gain unauthorised access to our systems.
• Interfere with the proper functioning of the Platform.
• Engage in price manipulation, review fraud, or abuse of promotions.
• Resell goods purchased for personal use in a manner that violates our policies.

8. Intellectual Property

All content on the Platform, including logos, text, graphics, software, and data, is the property of Almiola or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Loyalty Program & Gift Cards

Loyalty points and gift cards are subject to their respective terms, have no cash value unless stated, may expire, and cannot be transferred or sold. Almiola reserves the right to modify or terminate loyalty programs with reasonable notice.

10. Limitation of Liability

To the fullest extent permitted by law, Almiola shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you paid for the relevant transaction giving rise to the claim.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted, error-free operation.

12. Governing Law

These Terms are governed by the laws of the Kingdom of Lesotho. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lesotho.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
